Consumer Dispute Resolution

We are not willing or obligated to participate in dispute resolution proceedings before a consumer arbitration board.

Terms and Conditions

1. Scope

These Terms and Conditions govern the use of the mobile application "Athlory" (hereinafter "App") by you (hereinafter "User"). The operator of the App is Helge Busemann, Athlory, Saarlandstraße 1, 25421 Pinneberg, Germany (info@athlory.de, +49 171 5317646). The contract language is German. The place of jurisdiction is Pinneberg; German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

2. Subject Matter of the Contract

Athlory provides a software platform to support fitness and nutrition. This includes, among others:

• Training plans
• Tracking of workouts, weight, and age
• Nutrition diary and supplements management
• Messenger function with gym buddies and coaches
• AI integration ("Gemini")
• Upload of check-in photos

3. Registration and User Account

(1) Registration is required for all online features. During registration, name, email, and login data are stored in Supabase. All other data (training and nutrition data, supplements, check-in photos) are stored locally and only transmitted to a coach upon release.

(2) The user is responsible for the security of their access credentials.

4. User Obligations

(1) The App may not be used for illegal or immoral purposes.

(2) Uploads may only contain own, non-infringing content. In case of violation, the provider may block access.

(3) Coaches act as independent service providers. The provider only provides the technical platform; the content-related support and liability lie solely with the coach.

5. Paid Subscriptions and Cancellation

(1) Free (free): Basic tracking, progress statistics, cloud backup.

(2) Starter (€ 4.99/month): All Free features plus AI Meal Tracking (limited), AI macro calculation, coach connection possible.

(3) AI Pro (€ 7.99/month): All Starter features plus AI Meal Tracking (high limits), AI training plan creation, advanced analytics, priority support.

(4) Coach (€ 17.99/month): All AI Pro features plus unlimited clients, client dashboard, check-in management, video feedback tools.

(5) Studio (Enterprise): Multi-coach management, custom branding, API access. Pricing on request.

(6) Billing and renewal are handled exclusively through Apple App Store or Google Play Store. Cancellation must be done there via account management.

(7) Upon uninstalling the App, all locally stored data will be lost; the account can be deleted at any time by the user.

6. Data Usage and Privacy

The provider collects and processes personal data in accordance with GDPR. For details, please refer to the separate Privacy Policy.

7. Warranty and Liability

(1) There is no entitlement to specific functionalities or updates.

(2) The provider is fully liable for intent and gross negligence.

(3) In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to the typically foreseeable damage.

(4) The provider assumes no liability for health damage caused by improper use (e.g., training injuries).

8. Changes to the Terms and Conditions

The provider may change these Terms and Conditions. Users will be informed of significant changes via email. If the user does not object within six weeks, the changes are deemed accepted.

9. Final Provisions

Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected. The place of jurisdiction is Pinneberg; the law of the Federal Republic of Germany applies.
